CrowdStrike\u00a0on Sunday said\u00a0Delta Air Lines\u00a0had rejected on-site help during last month\u2019s\u00a0massive outage\u00a0that sparked thousands of\u00a0flight cancellations.<\/p>\n
Delta CEO Ed Bastian told CNBC\u2019s \u201cSquawk Box\u201d last week that the mass cancellations following the outage, which occurred at one of the busiest times of the year, cost the company\u00a0about $500 million, including customer compensation. The airline has \u201cno choice\u201d but to seek damages, he said.<\/p>\n
Bastian told staff on Friday that the airline had informed CrowdStrike and\u00a0Microsoft\u00a0that the company was \u201cplanning to pursue legal claims\u201d to recover its losses stemming from the outage and that it had hired law firm Boies Schiller Flexner.<\/p>\n
In response, Michael Carlinsky, CrowdStrike\u2019s lawyer and co-managing partner at Quinn Emanuel Urquhart & Sullivan, wrote to Delta\u2019s lawyer David Boies on Sunday that Delta\u2019s litigation threats \u201ccontributed to a misleading narrative that CrowdStrike is responsible for Delta\u2019s IT decisions and response to the outage.\u201d<\/p>\n
He said CrowdStrike CEO George Kurtz reached out to Bastian to \u201coffer onsite assistance, but received no response.\u201d<\/p>\n
Delta canceled more than 5,000 flights between the July 19 outage, caused by a botched software update, through July 25, more than its rivals.<\/p>\n
CrowdStrike shares have lost more than 36% of their value since the outages affected millions of computers running the company\u2019s software atop Microsoft\u2019s Windows operating system. The outage hit industries from banking to health care to air travel.<\/p>\n
\u201cShould Delta pursue this path, Delta will have to explain to the public, its shareholders, and ultimately a jury why CrowdStrike took responsibility for its actions\u2014swiftly, transparently, and constructively\u2014while Delta did not,\u201d Carlinsky\u2019s letter said.<\/p>\n
He said Delta would have to preserve a series of documents, including those describing its information-technology infrastructure, IT business continuity plans and its handling of outages over the past five years.<\/p>\n
CrowdStrike\u2019s contractual liability is capped in the single-digit millions, the letter said. Delta did not comment on the letter on Sunday night. In a separate statement, CrowdStrike said it hopes \u201cDelta will agree to work cooperatively to find a resolution.\u201d<\/p>\n
\u201cWe did everything we could to take care of our customers over that time frame,\u201d Bastian said in an interview Wednesday on CNBC\u2019s \u201cSquawk Box.\u201d \u201cIf you\u2019re going to be having access, priority access, to the Delta ecosystem in terms of technology, you\u2019ve got to test this stuff. You can\u2019t come into a mission critical 24\/7 operation and tell us we have a bug. It doesn\u2019t work.\u201d<\/p>\n
CrowdStrike vowed to release future software updates in stages in a preliminary post-incident report.<\/p>\n
On July 30, CrowdStrike shareholders filed a suit against the company in a Texas federal court and sought damages for declines in their investments.<\/p>\n
CrowdStrike reports fiscal second-quarter results Aug. 28.<\/p>\n
A Microsoft spokesperson did not immediately respond to CNBC\u2019s request for comment.<\/p>\n<\/p>\n
