{"id":12616,"date":"2024-11-26T00:00:42","date_gmt":"2024-11-26T00:00:42","guid":{"rendered":"https:\/\/businesstriumphs.com\/index.php\/2024\/11\/26\/judge-says-he-must-still-approve-sale-of-infowars-to-the-onion\/"},"modified":"2024-11-26T00:00:42","modified_gmt":"2024-11-26T00:00:42","slug":"judge-says-he-must-still-approve-sale-of-infowars-to-the-onion","status":"publish","type":"post","link":"https:\/\/businesstriumphs.com\/index.php\/2024\/11\/26\/judge-says-he-must-still-approve-sale-of-infowars-to-the-onion\/","title":{"rendered":"Judge says he must still approve sale of Infowars to The Onion"},"content":{"rendered":"<p class=\"\">A federal judge said Monday he may hold an evidentiary hearing next month to help determine whether to approve the sale of conspiracy theorist Alex Jones\u2019 media company to satirical publication The Onion.<\/p>\n<p class=\"\">Bankruptcy Judge Christopher Lopez in Houston clarified the sale, which comes after a Nov. 13 auction, remains in limbo until such a hearing, when interested parties can make their case and he can decide which of Jones\u2019 assets, if any, can be sold. A date was not immediately set.<\/p>\n<div><\/div>\n<p class=\"\">He also declined to immediately rule on Jones\u2019 request for a temporary restraining order to disqualify the Onion\u2019s bid, and said \u2018whatever was status quo pre-auction remains status quo\u2019 \u2014 essentially allowing Jones to remain broadcasting from his flagship platform, Infowars, for the time being.<\/p>\n<p class=\"\">\u2018Firing folks a week before Thanksgiving is not what we do, but it sounds like that\u2019s not what occurred,\u2019 Lopez said. \u2018Folks are continuing to work.\u2019<\/p>\n<p class=\"\">Another bidder, First United American Companies, a limited liability company affiliated with Jones\u2019 dietary supplements business, had challenged the results of the auction after it said it bid twice as much cash as the Onion.<\/p>\n<p class=\"\">At stake is the ownership of Infowars\u2019 intellectual property, including its website \u2014 the prized asset in the auction in which proceeds are largely meant to help satisfy defamation verdicts awarded to several families of the victims of the 2012\u00a0Sandy Hook Elementary School shooting.<\/p>\n<p class=\"\">The families won lawsuits against Jones in 2022 after he repeatedly called the massacre that left 20 children and six staff members\u00a0dead in Newtown, Connecticut, a \u2018hoax\u2019 on his Infowars broadcast. He filed for bankruptcy in his home state of Texas in the wake of the nearly $1.5 billion in legal judgments.<\/p>\n<p class=\"\">Jones\u2019 company, Free Speech Systems, was set to go to the Onion, which has often mocked him in its faux news coverage, after bankruptcy trustee Christopher Murray\u00a0announced the winning bid.<\/p>\n<p class=\"\">But First United American Companies quickly contested the results, saying in an emergency filing attempting to block the sale that it had offered $3.5 million in cash \u2014 compared to the Onion\u2019s $1.75 million.<\/p>\n<p class=\"\">The auction process approved by Lopez did not require Murray to automatically select the bidder that submitted the highest amount, and the trustee could reject the bid that was \u2018contrary to the best interests\u2019 of the estate creditors.<\/p>\n<p class=\"\">Lopez said Monday that the focus of an evidentiary hearing will be on Murray\u2019s business judgment in regard to how the auction was held. He said he may decide to approve the sale, order another auction or hold additional hearings.<\/p>\n<p class=\"\">\u2018I want a fair and transparent process, and let\u2019s see where that process goes,\u2019 Lopez said, adding, \u2018Everyone will have their day in court.\u2019<\/p>\n<p class=\"\">At a prior court hearing following the auction, Murray said, \u2018the creditors ended up significantly better off\u2019 under the Onion\u2019s bid. He also explained in a filing that the majority of Sandy Hook families were willing to forgo their share of the sale proceeds and instead take a percentage from future revenues from a revamped Infowars, which would allow the other creditors to collect more money.<\/p>\n<p class=\"\">The Onion estimates its total bid value is $7 million.<\/p>\n<p class=\"\">But Walter Cicack, a lawyer for First American United Companies, said in its filing that the arrangement amounts to a \u2018Monopoly\u2019 money bid since any future revenues are undetermined.<\/p>\n<p class=\"\">\u2018This was not simply collaboration,\u2019 he said of the Onion\u2019s support from Sandy Hook families, \u2018this was outright collusive bid rigging.\u2019<\/p>\n<p class=\"\">Chris Mattei, an attorney for some of the victims\u2019 families, said in a previous statement that\u00a0the Onion did \u2018a public service\u2019 by spearheading the purchase and \u2018will meaningfully hinder Jones\u2019 ability to do more harm.\u2019<\/p>\n<p class=\"\">Lawyers for the Onion said in a filing Sunday that the company has been \u2018harassed and threatened by the Debtor and members of his audience since their winning bid was announced.\u2019 They argued that the sale should proceed, writing that a joint bid \u2018does not amount to collusion\u2019 and disputing the idea that there was a lack of transparency because the auction used a sealed bid process.<\/p>\n<p class=\"\">\u2018Sealed bids maintain the competitive tension between bidders and force bidders to offer up their best terms irrespective of where other bids sit,\u2019 the lawyers wrote, adding, \u2018Far from maintaining this process in secrecy, once the Trustee selected the Successful Bidder, the Trustee publicly disclosed all information about the Qualified Bids, including by disclosing copies of the initial and final bids submitted by each Qualified Bidder.\u2019<\/p>\n<p class=\"\">Onion CEO Ben Collins \u2014 who previously covered disinformation and conspiracy theories for NBC News \u2014 had said on social media that while \u2018the judge had some questions about process and assets,\u2019 its \u2018bid with the families is clearly the best.\u2019<\/p>\n<p class=\"\">Collins also wrote that the Onion plans to relaunch Infowars as \u2018the dumbest website on the internet.\u2019 A person with knowledge of the sale\u00a0told NBC News the new platform will include well-known internet humor writers and content creators.\u00a0<\/p>\n<p><span class=\"caption__container\">A poster for The Onion on a wall in Manhattan\u2019s East Village on Nov. 17.<\/span><span class=\"caption__source\">Samuel Rigelhaupt \/ Sipa USA via AP<\/span><\/p>\n<p class=\"\">In announcing the sale, the Onion put out a news release written in the voice of a satirical CEO of Global Tetrahedron, the publication\u2019s Chicago-based parent company.<\/p>\n<p class=\"\">Infowars was briefly shut down after the sale was announced before it resumed operating with Jones, who claimed the site was \u2018hijacked.\u2019<\/p>\n<p class=\"\">Meanwhile, Jones \u2014 who built a small media empire off of promoting conspiracy theories and misinformation \u2014 has claimed that Elon Musk and President-elect Donald Trump are investigating the bankruptcy auction in his favor after Musk\u2019s X Corp. filed a notice of appearance in the case. X Corp. is presumed to be an interested party because Jones uses X to broadcast his show and the case involves the potential transfer of Jones\u2019 X handle in the sale.<\/p>\n<p class=\"endmark\">Lawyers for Jones filed a request last week for a temporary restraining order to invalidate the Onion\u2019s bid, and asserted that   First United American Companies should be the successful bidder.
